In San Diego I heard one speaker state something to the effect that ove the past 2 years there have been several civil law suites involving Missed Identifications.

I have info on the one where there was a 10-print miss of a subject who later went on and commited a murder but I do not know if there was a civil suite over it.

I also have the damages awarded in the McKie and Cowan case and if anyone has information about other civil awards for errorenous ID's I would like to know.

If you know of any civil cases involving miss or mis-ID prints you can post them here or send me the info by e-mail.

The reasoning is I am trying to make a point with my management.

Ray Krone was wrongly convicted on sexual assault & murder in Arizona. He was exonerated after 10 years in prison, when DNA and a previously unidentified fingerprint from the scene were identified to the actual perpetrator.

An AFIS search had been conducted years prior with no hits, although the actual suspect had good quality prints in the database at the time.

Mr. Krone received a large cash settlement prior to trial.

Another case was the 'Prime Time Serial Rapist' in Tucson, AZ in the late 1980's. Michael Cooper was erroneously identified to 2 latent prints in 2 separate cases, and arrested. The error was discovered within a day or two by an examiner in the original agency, although release of Mr. Cooper came much later, after confirmation of the errors by the state lab & FBI. There was an eventual settlement after a civil action, although the success may have revolved around alleged Miranda violations (that occurred after the alleged ID's), as in the erroneous ID's themselves. An interesting follow-up is that both latent prints were eventually correctly identified to a different suspect, who took his own life when confronted with arrest.
