Our LP Sections protocols have clearly defined erroneous identifications but they are deficient in defining the corrective actions of such an error. I've solicited input from other agencies but it seems that their protocols are just as ambiguous when it comes to establishing corrective actions. Does anyone out there have protocols that address the corrective actions of an erroneous identification? If so, does the protocol address the infraction comprehensively in its consideration of mitigating circumstances, previous quality issues by the examiner, retrospective review of the examiner's casework (and how far back), and any other peripheral issues?
Has your agency ever had to apply this protocol and if so, was it effective/successful? If rehabilitation/remediation was an option, did it work and did the examiner and/or peers experience court challenges as a result? I know this is a lot to ask but I'm hoping that others are seeking the same kind of information to incorporate into their own protocols. Thank you for taking the time to read.
