I will be genuinely surprised is this case moves forward. My understanding of how these biometric timeclocks work is very similar to how your phone fingerprint scanner works. The fingerprint itself is not retained in the system, only a list of minutiae locations. It should be pretty easy to argue that a list of x,y,theta data for an employee's finger is different then retaining the fingerprint impression image.
