Can anyone tell us here in Scotland exactly what is released to people charged with criminal offences in parts of America.
Can Prosecutors deny access to key Material Evidence ?
Exactly what types of evidence is disclosed to defence teams ?
When evidence is disclosed at trials is this evidence also disclosed at appeals ?
Can fresh defence teams ask and get access to all case papers at any time.
In Scotland our Crown Office can deny access to any document even Police Witness Statements, Forensic Reports, And ID Parade Reports.
To send people to prison for 20-30 years then deny them every and all documents in their possession for their appeal is Oppressive.
Our Crown Office have admitted they have a duty to disclose all material evidence but still cases are going to our Privy Council asking for and being refused access to all Crown Documents.
